Terms of Service

These Terms of Service ("Terms") govern your use of jara-trading.com and any tools, software, or content provided by João Jara, operating as Jara Trading ("we", "I", "us"). By using this site, downloading any Expert Advisor (EA), or submitting a form, you agree to these Terms.

1. Use of the website

You may browse, read, and download content from this site for personal, non-commercial use. You may not:

• Copy, modify, distribute, or republish content without permission
• Scrape or automatically extract content using bots
• Attempt to reverse-engineer any compiled EA file
• Use the site or any product for illegal activities

2. Free EAs

The free EA program ("JARA ORB") is provided under the following conditions:

2.1 Eligibility

• You must open or maintain a broker account through one of my partner links (currently IC Markets Global or Roboforex)
• The minimum deposit applies as stated on the Free EA page
• You must submit the request form with accurate information
• I reserve the right to verify and approve or reject any request at my discretion

2.2 License granted

• You receive a non-exclusive, non-transferable, revocable license to run the compiled EA on the specific MT5 account number(s) you have submitted
• The EA is locked by account number — it will not function on unauthorized accounts
• You may not redistribute, resell, or share the EA file with anyone
• You may not modify, decompile, or reverse-engineer the EA

2.3 Revocation

I may revoke EA authorization at any time, including but not limited to:

• If you close your broker account or transfer it away from my IB
• If you violate these Terms
• If you redistribute the EA
• If you abuse the support process
• At my sole discretion with reasonable cause

Authorization revocation means the EA will stop functioning on your account. I have no obligation to refund anything because the EA is free.

3. Paid products (MQL5 Marketplace)

EAs and utilities sold on the MQL5 Marketplace (Gold Spectrum, Gold Breakout Fusion, Range Breakout Fusion, New York Breaker, Broker XRay, EA Performance Hub) are subject to:

• MQL5 Marketplace Terms of Service
• MQL5's refund and licensing policies
• The Risk Disclaimer published on this site

4. Affiliate and IB relationships

I openly disclose all affiliate and introducing broker (IB) relationships on the Resources page. By clicking these links and signing up, you accept that:

• I may receive a commission from the third party
• There is no extra cost to you
• You are free to use alternative providers not affiliated with me

5. Intellectual property

All content on this site — including text, graphics, logos, EAs, indicators, code, and design — is the intellectual property of João Jara, unless otherwise indicated. Use of any content for commercial purposes requires written permission.

6. User-submitted data

When you submit the free EA request form or contact me by email, you confirm that:

• The information you provide is accurate
• You consent to my processing of your data as described in the Privacy Policy
• You authorize me to contact you regarding your request

7. Disclaimers and limitation of liability

All EAs, tools, and content are provided "as is" without warranty of any kind. Trading involves substantial risk of loss. See the full Risk Disclaimer for details.

To the maximum extent permitted by law, I am not liable for any losses, damages, or claims arising from your use of any product or content on this site.

8. Indemnification

You agree to indemnify and hold harmless João Jara from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your trading activities.

9. Modification of Terms

I may update these Terms occasionally. The "Last updated" date at the top will reflect the most recent change. Continued use of the site after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of Portugal. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force.
